The petitioner seeks bail in connection with Koran Sarai P.S. Case No.29/2016, registered for the offence punishable u/s 302, 307, 326/34 of the IPC and section 27 of the Arms Act. Vide order dated 15.02.2023, a report was called for, regarding the stage of trial. In compliance thereof, a report sent by learned Additional District and Sessions Judge-V, Buxar, dated 15.03.2023, is kept at flag 'A', whereby it is stated that out of ten witnesses, six witnesses have been examined. I.O. and Doctor have not been examined till today due to non availability of original record. Notice has been sent to Doctor and I.O. on 12.10.2022 and the time likely to be taken in conclusion of the sessions trial case is about six months.

Considering the submissions made in the report, I am not

Patna High Court CR. MISC. No.1718 of 2023(5) dt.29-03-2023 2/2 inclined to grant bail to the petitioner named above. The prayer for bail is hereby rejected.

Accordingly, the bail application is dismissed. However, the trial court is directed to conclude the trial as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of this order. It is made clear that if the trial is not concluded within the stipulated period, the petitioner is at liberty to file a fresh application for bail before this Court.
