1. The Writ petition is filed to quash the Letter No. 169 dated 23.08.2014 through which final assessment has been made under Section 135 of the Electricity Act, without considering the representation filed by the petitioner and he was directed to pay an amount of Rs. 4,78,224/-.

2. It is reported by the Learned counsel for the petitioner that the petitioner is no more and the letter dated 23.08.2014 issued by the

Patna High Court CWJC No.13218 of 2018(2) dt.08-07-2025 2/2 authorities is against the petitioner. However, a criminal case was registered against the petitioner under Section 135 of the Electricity Act as it is relating to theft of electricity.

3. In criminal cases, on the death of the accused the criminal case stands abated. If at all the respondent authorities have any grievances, they shall issue fresh notice against the legal heirs of the petitioner for recovery, which is always open for the respondent authorities. Until and unless there is no surviving cause of action against the legal heirs of the petitioner, the Writ petition shall stand closed.
