Petitioner apprehends his arrest in Mairwa P.S. Case No.76 of 2017 instituted for the offence under Section(s) 413, 414/34 Indian Penal Code pending in the Court of the Additional Chief Judicial Magistrate, VII, Siwan. It is alleged that stolen motorcycle was recovered from the Verandah of Aditya Kumar Yadav. He could not produce any paper. It is further alleged that on interrogation by the police, he disclosed that he deals in sale and purchase of stolen motorcycles with other co-accused as named in the written report. He has sold one motorcycle to Parash Nath Yadav (petitioner) and one Bandhu Choudhary. The police reached the house of the petitioner and recovered one Hero Super Splendor

Patna High Court Cr.Misc. No.50182 of 2017 (4) dt.18-12-2017 2/2 motorcycle bearing registration no.BR 29 T 2238. The petitioner could not produce any paper in support of the said vehicle. In the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on anticipatory bail. Prayer of the petitioner for grant of anticipatory bail is rejected.

Petitioner may surrender before the Court below and seek regular bail which shall be considered and disposed off in accordance with law without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
