JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-02-2023 Heard learned counsel for the petitioners and learned A.P.P appearing on behalf of the State. The petitioners are languishing in custody in a case registered for the offences punishable under Sections 8, 20 (b)(ii)(B) of the N.D.P.S. Act. There are recoveries of 5.048 Kgs and 5.105 Kgs of Ganja from the possession of petitioner Nos. 1 and 2 respectively.

It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been implicated in this case. Nothing has been

The petitioners have no concern with the seized contraband. Moreover, the seized contraband is under the commercial quantity. The petitioners are languishing in custody since 20.08.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the facts aforesaid and the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Special Judge, N.D.P.S Act, Purnea in connection with Excise (Purnea) P.S. Case No. 360 of 2022.
