JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 16-10-2019 Petitioner has filed the aforesaid modification application for extension of period of surrender before the learned Court below with the case that vide order dated 17.07.2019, while rejecting the bail prayer of the petitioner, he was directed to surrender before the learned lower Court within six weeks from the date of order and the learned Court below was directed to dispose of the bail petition of the petitioner without being prejudiced by the order of this Court but due to communication gap petitioner could not surrender before the learned Court below within the stipulated period. In the facts and circumstances of the case, the petitioner is directed to surrender before the learned Court

Patna High Court CR. MISC. No.61086 of 2019(2) dt.16-10-2019 2/2 below within three weeks from the date of receipt of order and seek regular bail and the learned Court below shall dispose of the bail petition of the petitioner on the very date of surrender without being prejudiced by order of this Court. Accordingly, this modification application is disposed of.
