Mr.Yogendra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-10-2024 Heard learned counsel for the petitioner and learned A.P.P for the State.
2. The petitioner apprehends his arrest in a case registered for offence under Sections 448, 341, 323, 506, 354(B) of the Indian Penal Code.
3. As per prosecution case, this petitioner, on the point of pistol, tried to commit rape with the victim (informant).
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. As a matter of fact, petitioner is a Vikas Mitra / Siksha Sevak and used to motivate the villagers to send their wards to school, but due to dirty village politics, he has been falsely implicated in this case. He next submits that F.I.R. has been lodged after a delay of 39 days and there is no plausible explanation of delay.

5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that petitioner is named in the F.I.R. and there is specific and direct allegation against him that on the point of pistol, he forcibly entered in informant's house and tried to commit rape with her.
6. Considering the nature of accusation, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay U T
