2. Heard Mr. Shailendra Kumar Jha, learned counsel appearing for the Petitioners, Mr. Ramchandra Sahni, and Mrs. Rita Verma, learned APPs for the State.

3. The petitioners apprehend their arrest in connection with Khajauli P.S. Case No. 133/2025 corresponding to G.R. No. 933/2025 dated 07.07.2025 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, ( hereinafter referred as ' Excise Act').

The main submissions advanced by the petitioners' counsel are that the instant matter relates to the recovery of 369 litres of Nepali country made liquor but the same is alleged to have been recovered from the bank of a river which is a public place and the recovery is said to have been made at late evening and both the petitioners have been made accused mainly on the basis of identification made by local police chowkidar who claimed to have identified them as the persons who managed to escape upon seeing the police party but except the said identification made by the said police chowkidar, there is nothing to show the petitioners' involvement in connection with seized liquor and further, the concerned police chowkidar did not disclose the source of such identification made in late evening. It is lastly submitted that in view of the circumstances, relating to the commission of the alleged offence punishable under Excise Act mentioned in the FIR, the said offence does not attract even prima facie against the petitioners and therefore,
Patna High Court CR. MISC. No.65006 of 2025(2) dt.24-09-2025 3/3 their prayer for anticipatory bail is not hit by the provisions of Section 76(2) of the Excise Act.
5. Learned APPs appearing for the State have opposed the prayer for bail of the petitioners.
6. In the facts and circumstances of this case, as well as considering the submissions as stated above, in my opinion, the petitioners deserve the relief of anticipatory bail. Accordingly, let the petitioners named-above, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Khajauli P.S. Case No. 133/2025 corresponding to G.R. No. 933/2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
