The petitioner apprehends his arrest in connection with Darauli P.S. Case No. 114 of 2022 registered under Sections 452, 341, 323, 307, 353, 504, 506/34 of the I.P.C. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to election dispute. There is general and omnibus allegation against the petitioner. Petitioner has no criminal antecedent.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending that in the first information report, there is direct allegation of assault by means of knife, which caused injury on the left palm

Patna High Court CR. MISC. No.63580 of 2022(2) dt.09-01-2023 2/2 of the informant. The injury report also corroborates the allegation as alleged in the first information report. Hence, the petitioner does not deserve to be enlarged on anticipatory bail. Having considered the facts and circumstances of the case and nature of the allegation, this Court is not inclined to grant anticipatory bail to the petitioner.
