The petitioner seeks bail in Sahiyara P.S. Case No. 97 of 2017 registered under Section 304-B/34 of the Indian Penal Code.

As per the prosecution case, the husband of the deceased, namely, Vijay Paswan made dowry demand and on non fulfillment of the same he along with his family members set ablazed her.

It is submitted by learned counsel for the petitioner that the petitioner happens to be brother-in-law of the deceased. He has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He has not made any dowry demand rather as per the

Patna High Court Cr.Misc. No.51447 of 2017 (04) dt.21-12-2017 - 2 - F.I.R. itself the demand of dowry was made only by husband of the deceased. The petitioner has been languishing in custody since 13.06.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Sitamarhi in connection with Sahiyara P.S. Case No.97 of 2017.
