JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date : 30-07-2019 Heard learned counsel for the petitioner and learned counsel for the Veer Kunwar Singh University (hereinafter referred to as the 'University').

2. Learned counsel for the petitioner submitted that the present application has been filed alleging violation of the order dated 28.09.2016 passed in CWJC No. 15663 of 2016, which was an interim order.

3. After some arguments, he submitted that he may be permitted to withdraw the application to pursue the writ petition itself, which is still pending.

4. It was submitted that the then respondent no. 5 in the writ petition, who was posted as Principal of Sher Shah College, Sasaram was totally ineligible as he was a mere Lecturer and that too appointed on forged and fabricated certificate, which finding has been given even by the Hon'ble Supreme Court.

5. In view of the aforesaid, as prayed for by learned counsel for the petitioner, the application stands disposed off as withdrawn.
