2. In the present case, the petitioner seeks bail in connection with Sarmera P.S. Case No. 234 of 2022, registered for the offences under Sections 307, 326, 504 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the background of a pitty dispute, the petitioner opened fire on the informant and the shot hit on the right jaw of the informant.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has been falsely implicated in this case. From the FIR, it is clear that the goat of the informant used to damage the crop of the petitioner. Hot words were exchanged between them and some scuffle took

Patna High Court CR. MISC. No.65389 of 2025(3) dt.04-11-2025 2/3 place between them. There was no intention to cause death of the petitioner and this fact is apparent from the injury report. The initial injury report shows that the cause of injury was sharp and pointed object and there is only one injury. Further, report opined that something like bullet was inside the neck. From these facts, it appears that no fire arm injury was received by the informant. The petitioner has no criminal antecedent and is in custody since 08.07.2025. The charge-sheet has been submitted.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the clean antecedent of the petitioner, period of custody, submission of charge-sheet against the petitioner, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Sarmera P.S. Case No. 234 of 2022, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:

(i) One of the bailors will be a close

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
