JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2019 This is an application for grant of anticipatory bail in connection with Rajiv Nagar P. S. Case No. 255 of 2018 disclosing offences under Section 379 of the IPC and Section 4/40 of the Bihar Mines and Mineral (Concession Rules, 1972 and 3/6/8 of Bihar Minerals (Prevention of illegal mining transpiration and storage Rule, 2003.

As per F.I.R. allegation against the petitioner is that he has accumulated illegally stone chips and sands and he has produced the receipts also, but that receipts are also appears to be forged.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. He is ready to abide by any condition imposed on him.

Heard learned A.P.P. also.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.61843 of 2019(4) dt.20-12-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub-Judge-III, Patna, in connection with Rajiv Nagar P. S. Case No. 255 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that if in future he is found involved in such type of activity around his area, the prosecution is at liberty to move for cancellation of his bail bonds.
