2. The petitioner seeks regular bail in connection with Bihariganj P.S. Case No. 112 of 2023 dated 10.05.2023, lodged under Sections 25(1-AA), 25(1-b)a and 26 of the Arms Act read with Sections 8(c) and 21(b) of the NDPS Act.

3. Learned senior counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 29.02.2024 passed in Cr. Misc. No. 68886 of 2023 in which liberty was granted to him to renew his prayer for bail nine months after framing of charge. He submits that nine months have already been lapsed but till date, trial has not been concluded and the petitioner is in custody since 11.05.2023, as such, he may be granted bail.

4. Learned A.P.P. for the State on the other hand opposes the prayer for bail and submits that vide order dated 14.11.2024, progress report has been called for. From the report, it transpires to this Court that out of 6 witnesses, 5 witnesses have already been examined and only one witness is yet to be examined.

5. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner at present, therefore, his bail petition is hereby rejected.

6. The Trial Court is directed to expedite the trial within three months.
