The petitioner seeks bail in connection with Sahebpur Kamal P.S. Case No. 299 of 2021, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307 and 379 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case as emerges from the FIR is that on 17.12.2021, petitioner along with his associates assaulted the informant by Lathi, Danda and Iron Rod due to which he sustained injury. Allegation of

Learned counsel appearing on behalf of the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He further submits that allegation against the petitioner is that he had fired at Niraj Singh, however, there is no allegation of causing any injury to the alleged victim because as per the allegation itself, bullet had not touched the head of the alleged victim. He also submits that investigation in this case is complete and charge-sheet has already been submitted. The petitioner is languishing in custody since 29.06.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. However, Learned APP for the State vehemently opposes the prayer of the petitioner for bail. In the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs.
