====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018. As per the prosecution case, 26 liters of foreign liquor was recovered, and it is alleged that the same was to be delivered to this petitioner.

Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner.

However, learned A.P.P. for the State opposes the prayer for anticipatory bail and submits that petitioner has got three criminal antecedents of similar nature.

Considering the fact that petitioner has got criminal
