Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of Sasaram Town P.S. Case No. 601 of 2022 disclosing commission of offences punishable under Sections 420 of the Indian Penal

Patna High Court CR. MISC. No.63205 of 2022(2) dt.04-03-2023 2/3 Code and Section 63 of the Copy Right Act, 1957. Learned counsel for the petitioner appearing on behalf of the petitioner has submitted that he is in custody since 20.07.2022, and the maximum punishment for the offence punishable under Section-63 of the Copy Right, Act, 1957, is three years. He has further submitted that the FIR has been registered on the basis of the information furnished by a constituted attorney of M/s Hindustan Unilever Limited, with an allegation that during market survey, it was found that from the petitioner's shop, dealing with whole sale/retail business counterfeit cosmetic using brand name LAKME was being sold. It is his submission that the petitioner had purchased the said articles from an authorized dealer. He has further submitted that two other accused persons with similar allegation have been allowed bail by this Court by order dated 18.01.2023 passed in Criminal Miscellaneous No. 59757 of 2022 and order dated 02.03.2023 passed in Criminal Miscellaneous No. 59678 of 2022.

Considering the aforesaid submission and nature of allegation, this application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand), with two
