ANJANA MISHRA ORAL ORDER 15-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 18.03.2019, in connection with Aungari P.S. Case No. 22 of 2017 for the offenses under Sections 363, 365, 366, 366 A, 376 and 120(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the name of the petitioner is only transpired in the statement made by the victim girl before the Magistrate under Section 164 Cr.P.C. But it appears that in her statement made before the Magistrate, she does not state the name of the petitioner but claims that one lady whom she can identify had taken her away. Considering the submissions made and such probabilities, the petitioner may not be kept in custody as till

Patna High Court CR. MISC. No.61977 of 2019(2) dt.15-11-2019 2/2 date no TIP has been conducted though she has been in jail for more than six months.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Hilsa in connection with Augari P.S.
