2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 399 and 402 of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of the Arms Act and Sections 8, 8(c), 21(b), 20(b) (ii), (b), (c) of the NDPS Act.
3. The case of the prosecution is that from the possession of this petitioner one country made loaded pistol was recovered and from his left of trouser 12 grams of smack and from his right pocket of trouser one mobile phone were recovered.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

Learned counsel for the petitioner has submitted that the recovered smack is more than small quantity but it much lesser than commericial quantity. Moreover, the petitioner is languishing in judicial custody since 19.06.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail and submitted that petititioner has four criminal antecedents.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bajpatti P.S. Case No. 168 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Cum-Special Judge NDPS, Sitamarhi.
