This is an application for bail in connection with Kothi P. S.Case No. 40 of 2017 registered for the offences punishable under Sections 376, 420 of the Indian Penal Code and 4 of POCSO Act.

Allegation against the petitioner is that he has committed rape upon the minor girl of the informant on the assurance of marrying her.

Submission of learned counsel for the petitioner is that medical report shows that the girl was major and he is still ready to marry her, if she desires.

Having heard both sides and in view of facts and

Patna High Court Cr.Misc. No.49690 of 2017 (3) dt.14-11-2017 2/2 circumstances, as stated above, this application is disposed of with a direction to learned trial court that if petitioner offers for marrying her, he will be released on provisional bail for a period of four months and if marriage is solemnized the trial court will confirm his bail to its own satisfaction.
