The petitioner is languishing in custody since 14.2.2019 in a case registered for the offences punishable under Sections 399 and 402 of the I.P.C. and Sections 25(1-B) a, 26 and 35 of the Arms Act.

The prosecution case is that on information that the miscreants are preparing for committing dacoity, raid was laid when from the possession of the petitioner, one country made pistol and two live cartridges were recovered while other articles were recovered from other co-accused. It is submitted by learned counsel for the petitioner that the petitioner is accused in one other case and is in custody since more than eight months.

Considering the nature of recovery and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-13, East Champaran at Motihari in connection with Chakia P.S. Case No.40 of 2019.
