The petitioner seeks bail in connection with Uphara P.S. Case No. 26/2017 dated 17.06.2017 instituted for the offences under Sections 147, 148, 149, 302, 341, 323, 324, 326, 307 and 506 of the Indian Penal read with Section 27 of the Arms Act. The petitioner is in custody since 18.06.2017. The informant has alleged that while he along with his brother, Pappu Singh (deceased), was coming back from the field, accused persons surrounded him and started assaulting him. When the informant tried to run away, he too was apprehend and was assaulted by the accused persons. Many persons have been named in the F.I.R. The petitioner is alleged to have given a dagger blow. The deceased died because of four sharp cut injuries on his person. The informant has received two sharp cut injuries on his body.
Patna High Court Cr.Misc. No.51985 of 2017 (3) dt.01-12-2017 2/2 Learned counsel for the petitioner submits there is a land dispute between the parties and on preliminary enquiry the matter has been settled in favour of the petitioner. The petitioner does not bear any criminal antecedent. Some of the accused persons, who were armed with danda etc. and were shown only members of the mob, have been granted bail by a co-ordinate Bench of this Court by order dated 19.09.2017 passed in Cr. Misc. No. 41649/2017. Chargesheet in this case has already been submitted. Taking into account the fact that many persons have been made accused in this case and that charge-sheet has been submitted and further, considering the period of custody of the petitioner and that he does not bear any criminal antecedent, this Court is inclined to grant bail to him.
The petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Daudnagar, Aurangabad in connection with Uphara P.S.
