JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Daudnagar P.S. Case No. 339 of 2018 registered for the offences punishable under Sections 420 and 379 of the Indian Penal Code.

As per FIR it appears that fraudulently an amount of Rs.1.20 lac of the informant was withdrawn from ATM and transferred the same to some other account, as such case was lodged against unknown and later on during investigation it appears that some of the amount has been transferred to the account of the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated and even informant has not identified the petitioner in the CCTV footage. Heard learned APP, who has opposed the prayer for

Patna High Court CR. MISC. No.62028 of 2019(4) dt.26-11-2019 2/2 anticipatory bail of the petitioner.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner.

Accordingly, this application is dismissed.
