====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 19-09-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 413, 414, 420, 467, 468 and 471 of the I.PC.

The prosecution story, in brief, is that on 06.07.2019 at about 5.00 P.M., the informant during the patrolling duty, apprehended the petitioner alongwith one stolen Motorcycle who is an accused in Nautan (Jagdishpur) P.S. Case No. 147 of 2019. On interrogation, he disclosed his name and after demand the paper of Motorcycle, no any paper was produced with regard to the said Motorcycle and accepted that the said Motorcycle is stolen.

Patna High Court CR. MISC. No.59187 of 2019(2) dt.19-09-2019 2/2 It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 07.07.2019. The petitioner has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. One stolen Motorcycle is said to have been recovered from possession of the petitioner. The petitioner had no knowledge that the Motorcycle in question is stolen property. He has been made accused in the present case due to mistake of fact.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R/ Complaint Case. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Bettiah, West Champaran, in connection with Nautan (Jagdishpur) P.S. Case No. 270 of 2019.
