The petitioner seeks regular bail in connection with Mokama P.S. Case No. 57 of 2018, registered for the offence punishable under Sections 147, 148, 149, 302, 506 of the Indian Penal Code and Section 27 of the Arms Act.

As per FIR, there is specific allegation against one Navin Kumar is of firing on head causing death. Learned counsel for the petitioner submits that the informant is not eye witness of the occurrence. The petitioner is in custody since 16.04.2019, no chance of tampering with the evidence.

Learned APP has opposed the prayer of bail and

Patna High Court CR. MISC. No. 59573 of 2019(4) dt.06-02-2020 2/2 submits that there is specific allegation against the petitioner and the witnesses supported the allegation of firing on the deceased.

Considering the submission, I am not inclined to enlarge the petitioner on bail.

This application is accordingly dismissed.
