2. This is second anticipatory bail application on behalf of the petitioner. Earlier, the prayer for grant of anticipatory bail to the petitioner was dismissed as withdrawn vide order dated 04.07.2023 passed in Cr. Misc. No. 21166 of 2023.

3. After some argument, learned counsel for the petitioner seeks permission to withdraw this second anticipatory bail petition granting liberty to the petitioner to surrender before the Court below and make a prayer for regular bail.

4. Permission is accorded. The anticipatory bail

Patna High Court CR. MISC. No.68012 of 2023(3) dt.01-12-2023 2/2 petition stands dismissed as withdrawn.

5. However, if petitioner surrenders before the Court below in connection with aforesaid case within a period of six weeks from today and prays for regular bail, the learned court below, without being prejudiced by this order, shall examine the same and pass appropriate order in accordance with law.
