JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-09-2019 The petitioner had applied for her appointment as Anganbari Sahayika, at Maizara Centre No. 108, Ward No.7, Gram Panchayat Maizara in the district of Nalanda, along with other applicants, wherein one Sulekha Kumari was selected and it is the petitioner's case that she was placed in the merit list just below Sulekha Kumari.

Selection of Sulekha Kumari as Anganbari Sahayika was challenged by the petitioner by filing an appeal before the District Programme Officer, Nalanda, giving rise to Appeal Case

Patna High Court CWJC No.18394 of 2019(2) dt.20-09-2019 2/2 No.59 of 2019. The appeal has been allowed by an order dated 06.08.2019 on the ground that the documents, which were considered for selection of said Sulekha Kumar, were forged and fabricated. After having set aside the selection of Sulekha Kumari, the District Programme Officer, Nalanda, by his said order dated 06.08.2019, directed the Child Development Project Officer to appoint the candidate, who is next in the merit list. The petitioner has a grievance that despite the order of the appellate authority, the petitioner has not been appointed and the respondents are going to undertake fresh selection process for appointment to the said post of Anganbari Sahayika.

On perusal of the writ application, I do not find any material to suggest that any fresh process has been started for selection of Anganbari Sahayika. So far as grievance of the petitioner of non-compliance of the order dated 06.08.2019 is concerned, it is observed that the petitioner shall be at liberty to pursue her representation before the District Programme Officer, Nalanda.

This writ application is dismissed.
