This criminal revision application has been filed on 10.11.2015. Vide order dated 24.11.2015 limitation was condoned. Vide order dated 07.04.2016 notices were issued and it has been submitted by the counsel for the petitioner that petitioner is ready for one time settlement with the Opposite Party No.2. It was observed by this Court "It is made clear that this Court has not stayed the proceeding of Misc. (Maintenance) case No.66 of 2013 pending in the court of Principal Judge, Family Court, Madhepura and hence the Court below shall take

Vide order dated 27.02.2018 fresh notices were issued to the opposite party no.2 under both process. Vide order dated 09.08.2019 no one appeared on behalf of the petitioner to press this application and matter adjourned for 16.08.2019. On 23.08.2019 time was taken by counsel for the petitioner to bring the order sheet of the trial Court by filing an affidavit, as such matter adjourned for 6th of September, 2019. On 06.09.2019 again adjournment was taken in the name of filing the affidavit and matter was fixed on 27.09.2019, thereafter this case was taken up on 13.02.2023. On 13.02.2023 counsel for the petitioner sought adjournment and this case was directed to be listed on 20.02.2023. On 20.02.2023 counsel for the petitioner again prayed for adjournment and this case has been fixed on 13.03.2023. Today this case was listed again and no one appears on behalf of the petitioner.
In this circumstances, I found that the petitioner is not interested to pursue the matter and therefore, this criminal revision application is hereby dismissed due to non-prosecution. (Dr. Anshuman, J.) ravishankar/- U T
