The petitioner seeks pre-arrest bail in connection with Thakurganj P.S. Case No. 105 of 2016 registered under Sections 420, 467, 468, 471 and 120-B of the Indian Penal Code. According to the first information report, the allegation against the petitioner is that the certificate as produced by her showing experience to be not genuine as the number on it did not match with the issuance register.
It is submitted by the learned counsel for the petitioner that two other male accused named in the FIR along with the petitioner against whom there is identical allegation
Patna High Court Cr.Misc. No.51109 of 2017 (3) dt.17-11-2017 have already been granted pre-arrest bail by this Court vide order dated 03.04.2017 passed in Cr. Misc. No.3811 of 2017 and Cr. Misc. No.4169 of 2017.
Learned counsel for the Vigilance has opposed the application for grant of pre-arrest bail to the petitioner. However, he admits that other co-accused having identical allegation have already been granted pre-arrest bail by a co-ordinate Bench of this Court.
Having regard to the facts and circumstances of the case as also in order to maintain consistency, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Thakurganj P.S. Case No. 105 of 2016 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
