The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 302, 120B and 34 of the Indian Penal Code.
The allegation against the petitioner and others is of brutally assaulted the husband of the informant leading to his death.
It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. He submitted that only on the basis of suspicion of the informant, the petitioner has been roped in this
Patna High Court CR. MISC. No.64630 of 2022(3) dt.24-03-2023 2/2 case along with other co-accused persons. There is no eyewitness, no consistent evidence to show that the petitioner had assaulted the deceased, who succumbed to injury. Learned counsel for the petitioner further submitted that the other coaccused has already been granted bail vide order dated 21.03.2023 by this Bench passed in Cr. Misc No. 43464 of 2022. It is also submitted that petitioner is languishing in judicial custody since 14.02.2022.
Learned APP appearing for the State has vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Nawkothi( Garhpura) P.S. Case No. 21 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-I, Begusarai. (Sunil Kumar Panwar, J) Arish/- U T
