JUSTICE ARVIND SRIVASTAVA ORAL ORDER 12-12-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Habibpur Police Station Case No. 54 of 2016, disclosing offences under Sections 341, 323, 406, 420, 467, 471, 385 and 379 of the Indian Penal Code.
Learned counsel for the petitioner has submitted the petitioner is innocent and has not committed any offence. In fact, there is land dispute between the parties and on account of that this petitioner has falsely been implicated in this case. The dispute is purely civil in nature and for that no criminal liability be imposed on the petitioner. Hence, the petitioner deserves the privilege of anticipatory bail.
