Mr. Ashhar Mustafa, learned counsel appearing on behalf of the Tilka Manjhi University, Bhagalpur submits that he has received instruction that the petitioner has already been paid Rs.10 lacs provisionally on account of gratuity and remaining amount will be paid within a short span of time after final verification of the pension and other retiral dues by the Pay Verification Cell of the University.

3. Learned counsel appearing on behalf of the petitioner submits that the petitioner has suffered a lot and the University is solely responsible for delaying the matter relating to payment of retiral dues to the petitioner.

4. Considering the rival submission as well as on perusal of the counter affidavit, it appears that substantial amount of retiral dues has been paid to the petitioner provisionally, however final payment is subject to final determination by the Pay Verification Cell.

5. Registrar of the Tilka Manjhi University, Bhagalpur - respondent no. 3 is directed to ensure that Pay Verification Cell determines the payment of retiral dues

Patna High Court CWJC No.15975 of 2022 dt.31-07-2023 3/3 including pension as well as remaining amount of gratuity, if any which is required to be paid to the petitioner in accordance with law within a period of three weeks.

6. The petitioner, if so advised, may file a detailed representation before the appropriate authority for redressal of any grievance which still requires to be redressed by the University.

7. If any amount was recovered while fixing pension and making payment of retiral dues provisionally, the same may be adjusted with the final payment.

8. The writ petition, accordingly, stands disposed of.
