1. Though the present writ petition has been filed for executing and implementing the order dated 16.03.1998, passed by the Ld. House Controller as also the appellate order dated 23.09.2006, passed by the Collector, Bhojpur at Ara and the revisional order dated 24.01.2012, passed by the Comissioner, Patna Division, Patna and for making payment of the arrears of rent with regard to the premises known as "Sone Villa Bhavan",
Patna High Court CWJC No.17612 of 2015(3) dt.19-09-2024 2/2 Koilwar, being used as godown and store room by the respondents, who had taken the same on rent, however, at the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the appropriate authority for execution of the said orders and further seeks a direction upon the Executing Authority to dispose off the petition to be filed by the petitioner within a stipulated time frame. Liberty so sought is granted.
2. It is needless to state that in case appropriate execution petition is filed within a period of three weeks from today, the Executing Authority shall ensure implementation of the aforesaid orders, within a period of three months, thereafter, in case there is no other legal impediment and in case the aforesaid orders have not been set aside by any higher Forum/Court of law.
3. The writ petition stands disposed of on the aforesaid terms.
