JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-09-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State as well as C.B.S.E. Learned counsel for the petitioner submits that there is innocent typographical error in the spelling of the name of father of the petitioners and for correction of the same. Petitioner has approached the C.B.S.E. but the C.B.S.E. has not corrected the record on the ground of delay.
Mr. Vinay Krishna Tripathi, learned counsel appearing on behalf of C.B.S.E. submits that time is the essence in the
Patna High Court CWJC No.19017 of 2019(2) dt.13-09-2019 2/2 matter of correction and after expiry of the time the C.B.S.E. has no difficulty in making correction in the record. After considering the rival contention, the Court find that the correction sought for by the petitioner in the present application is very innocent error i.e. instead of 'Masiur Rahman' it was wrongly typed as 'Mastur Rahman'. Such innocent typographical error is not going to change the record materially. Under the aforesaid circumstance, the Court directs the C.B.S.E. to carry that correction at the earliest. With the aforesaid liberty, the present writ application stands disposed of.
