2. The petitioner seeks bail in a case registered for the offence punishable under Sections 126(2), 115(2), 103, 123, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the FIR, on 25.05.2025 at about 10:00 hours, the daughter of the informant went to the house of the petitioner after receiving a phone call from the petitioner. When she reached the petitioner's house, the petitioner, along with other co-accused persons assaulted her and forcibly administered poison to her. Subsequently, during the course of treatment, the daughter of the informant died.

4. Learned counsel for the petitioner submits that informant is not eye-witness of the occurrence. As a matter fact,

No.64456 of 2025(3) dt.11-11-2025 2/2 informant's daughter had love affair with the petitioner and she wanted to marry with the petitioner and when the informant's family refused to marry her with the petitioner, the daughter of informant committed suicide by consuming poison. Petitioner claims clean antecedent and he is in custody since 26.05.2025.

5. Learned APP however, vehemently opposes the prayer for bail and submits that petitioner is named in the FIR and there is specific allegation that he along with co-accused persons assaulted the deceased and forcibly administered poison to her, as a result of which the daughter of informant died.

6. Considering the nature of accusation, I am not inclined to enlarge the petitioner above-named on bail in connection with Mathurapur PS Case No. 53 of 2025 pending in the Court of learned Judicial Magistrate Ist, Samastipur. Accordingly, the same is rejected.
