1. The Writ petition has been filed challenging the order of the District Consumer Forum, Jehanabad, where the case No. 42 of 2023 has been dismissed on the ground that the complaint was barred by limitation, in spite of filing an application for condonation of the delay.

2. Against the order passed by the District Consumer Forum, Jehanabad, the appropriate remedy is to prefer an appeal before State Consumer Forum.

3. On the other hand, the Learned counsel for the respondents contended that as far as the Electricity Act is concerned , the petitioner ought to have approached the Consumer Grievances Redressal Forum (CGRF), under Section 42(5) of the Act. However, the petitioner filed a complaint before the District Consumer Forum, Jehanabad.

4. At this juncture, the Learned counsel for the petitioner intends to withdraw the present Writ petition with liberty to approach before the appropriate forum.

5. Liberty is granted.

5. Accordingly, the Writ petition is dismissed as withdrawn.
