The petitioner apprehend his arrest in connection with Manpur P.S. case no.69 of 2020, registered for the offence punishable under sections 147, 148, 149, 342, 307, 504, 506 of the Indian Penal Code and 27 of Arms Act.

As per the FIR, the accused persons started throwing stones, chips and fired on the house of one Sidheshwar Paswan. It is alleged that during this course, the petitioner made a firing of rifle, which hit on the right leg of the informant's daughter. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and have committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation

Patna High Court CR. MISC. No.2283 of 2023(2) dt.09-02-2023 2/2 levelled against the petitioner is not specific rather general and omnibus in nature. There is a case and counter-case between the parties. Earlier the petitioner's side filed a case against the informant and informant's side thereafter, the informant has filed the present case against the petitioner and other accused persons. Petitioner has no criminal antecedent. Learned APP for the State opposed the prayer for anticipatory bail by submitting that there is specific allegation against the petitioner to open fire which hit on the right leg of the informant's daughter due to which she sustained injuries and the injury report has also supported this fact. Having regard to the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. Accordingly, this application is dismissed.
