2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 394 of the Indian Penal Code, registered in connection with Sakri P.S. Case No. 136 of 2024.

3. Allegedly, in sleeping state near his shop, the mobile of Bhagina of the informant was being tried to steal by some unknown person and on protest made by Bhagina of the informant, he was assaulted by that unknown person with knife

Patna High Court CR. MISC. No.67417 of 2024(3) dt.29-11-2024 2/3 as a result of which the informant Bhagina sustained injury.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. The name of the petitioner has come into light on the basis of confessional statement of co-accused Bikash Kumar Yadav @ Bikash Kumar. No incriminating/stolen article has been recovered from the conscious possession of the petitioner. He submitted that the other co-accused has already been granted bail by this Court vide order dated 26.09.2024 passed in Cr. Misc. No. 67819 of 2024. The petitioner is a person of clean antecedent and he is in custody since 02.07.2024.

5. Learned APP for the State has opposed the prayer of bail.

6. Considering the above facts and circumstances of the case as well as petitioner having no criminal antecedent, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Sakri P.S. Case No. 136 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as
