2. The petitioners seek bail in a case, registered for the offence punishable under Sections 103, 238 of the Bharatiya Nyaya Sanhita, 2023 and Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. As per the FIR, on 27.03.2025 at about 10.00 P.M., informant's father proceeded with his truck, but on 28.03.2025 in the morning, the informant found his father's dead body lying near the Power House at Andharwari, and the truck was parked on the road. It is further alleged that Laxman Pandit (petitioner), who was the driver and was taking care of another truck belonging to the informant's father, had a hot exchange of words with him over a money matter. The informant suspects that the petitioner killed his father.

4. Learned counsel for the petitioner submits that informant is not eye-witness of the occurrence and petitioner has been made accused in this case only on suspicion based on alleged money dispute. During the course of investigation, in para 14 of the case diary, only material that has come against this petitioner is that this petitioner was found talking on mobile phone through WhatsApp and details of which were deleted. Petitioner claims clean antecedent and he is in custody since 30.03.2025.

5. Learned APP however, vehemently opposes the prayer for bail of the petitioner.

6. Considering the aforesaid facts, let the petitioner above-named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Rajauli P.S. Case No. 163 of 2025.
