Having been lodged in custody since 27.08.2017 In connection with Bodhgaya P. S. case no. 439 of 2017, registered under Sections 363, 366(A) of the IPC, the petitioner has prayed for bail.

The Nana lodged the case alleging that the victim had gone to attend the classes but did not return. On 27.07.2017, the victim appeared before the police and later before the Magistrate for recording her statement which is at Annexure-2. Learned counsel submits that she has accepted of having willingly married the petitioner. The entire statement was placed before the Court. He also states that the victim is presently living in the house of the petitioner as his duly legally wedded wife. Learned counsel placed the entire statement and

Patna High Court Cr.Misc. No.51047 of 2017(2) dt.20-11-2017 2/2 emphasized that the victim had attained the age of understanding.

In view of the above, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Gaya/ concerned Court in connection with Bodh Gaya P.S. case no. 439 of 2017,subject to the condition that one of the bailors of the petitioner shall be his own/close family member.
