====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 22-03-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State and learned counsel for the opposite party no.2.
2. The petitioner apprehends his arrest in connection with Mahila P.S. Case No.97 of 2021 instituted under Sections 323, 379, 498(A) and 504/34 of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act.
3. Learned counsel for the parties submits that both the parties have compromised during mediation proceeding at Patna High Court Mediation and Conciliation Centre. Both the parties agreed to live together as husband and wife with full dignity and honour. Presently the victim-wife is residing with
Patna High Court CR. MISC. No.67089 of 2023(5) dt.22-03-2025 2/3 the petitioner-husband at her matrimonial home.
4. Learned counsel for the informant submits that the petitioner is not allowing to meet the father and other family members with the victim-wife of the petitioner.
5. Learned counsel for the petitioner submits that the petitioner shall not obstruct for meeting of the family members of victim-wife with her.
6. In view of the submissions of learned counsel for the parties and also the fact that both husband and wife are residing together and leading happy conjugal life, this Court is inclined to grant anticipatory bail to the petitioner. Accordingly, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned S.D.J.M., Darbhanga in connection with Mahila P.S. Case No.97 of 2021, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 with further following condition:- (i) In case the petitioner treats the victim-wife with cruelty, the informant shall be at liberty to move for cancellation of bail of the petitioner before the concerned Court and the
