The petitioners seek bail in connection with Jandaha P.S. Case No. 36 of 2017 registered under Sections 302, 201, 120(B)/34 of the Indian Penal Code.
Petitioners who happen to be mother-in-law and wife respectively of the deceased are said to have committed murder of the deceased in their house by hatching conspiracy. It is submitted by learned counsel for the petitioners that the deceased has died due to assault sustained by him during altercation with some unknown miscreants in the badhar. The petitioners have been falsely implicated in the case. Sister-in-law of the deceased namely, Pinki Devi had informed the informant
Patna High Court Cr.Misc. No.52640 of 2017 (3) dt.12-12-2017 about the incident. Though, the doctor has opined the cause of death due to asphyxia caused by throttling but there is no such corresponding injury found on the person of the deceased as ante mortem injury. Petitioners happen to be ladies and they have been languishing in custody since 01.06.2017.
Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.MXIth, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 36 of 2017.
