JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-01-2015 Petitioner is languishing in custody since 27.07.2014 in a case registered for the offences punishable under Sections 366(A), 120(B)/34 of the I.P.C. The accusation is of kidnapping the minor daughter of the informant and establishing forceful physical relationship.

It is submitted by learned counsel for the petitioner that the victim girl has married with the nephew of the petitioner and compromise petition has been filed before learned Court below. The petitioner is uncle of Chhotu Kumar with whom the victim girl has married. The petitioner was not named in the F.I.R but his name subsequently sprang up. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.803 of 2015 (2) dt.09-01-2015 2/2 amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sherghati, Gaya in connection with Imamganj P.S. Case No. 120 of 2013.
