The petitioner apprehends her arrest in connection with Ara Nawada P.S. Case No. 840 of 2018/ Excise Case No. 2314 of 2018, registered under Section 30(a) of the Bihar Excise Act, 2016.

The accusation is of recovery of 10 litres country made liquor kept in a bag from the motorcycle of the petitioner. Learned counsel for the petitioner submits that, in fact, the seized liquor is said to be recovered from the bag, which was kept on the motorcycle of the petitioner but the said motorcycle was taken by his relative, Rakesh Kumar, son of Dipan @ Deepu Yadav, resident of village- Larladpur, P.S.

Patna High Court CR. MISC. No.60947 of 2019(2) dt.26-09-2019 2/2 Rania Talab, Distt.- Patna and she had no knowledge about carrying the aforesaid liquor from her motorcycle. Further submission is that petitioner being the lady has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Special Judge, Excise Act, Bhojpur, in connection with Ara Nawada P.S. Case No. 840 of 2018/ Excise Case No. 2314 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
