The petitioner in the present case is seeking regular bail in connection with GRP/Kiul (Nawada) P.S. Case No.53 of 2019 registered for the offence punishable under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that petitioner is not named in the FIR and his name has transpired in the confessional statement of the co-accused Vikram Kumar.

Learned APP has opposed the prayer for bail.

The Court is of the opinion that releasing the petitioner at this stage would amount to putting the society at large in

Patna High Court CR. MISC. No.62550 of 2019(3) dt.03-12-2019 2/2 danger.

Considering the facts and circumstances of the case wherein there are four cases on the head of this petitioner, he has been identified by the informant in the T.I.P. and three looted mobiles have been recovered from his possession, this Court is not inclined to grant regular bail to the petitioner at this stage. This application is dismissed.

Let the trial be expedited.
