The petitioners apprehend their arrest in connection with Pipra P.S. Case No. 274 of 2015, registered for the offences punishable under Sections 406, 420, 341, 323, 324, 379, 380, 504, 506/34 of the Indian Penal Code.
This case has been lodged on the basis of complaint case wherein in short, allegation against petitioner nos. 1 and 2 is for abusing whereas allegation against petitioner no.3 is for taking Rs. 1000/- from the pocket.
Submission is of false implication and that no such occurrence has taken place, manner of occurrence as alleged is not
Patna High Court Cr.Misc. No.52347 of 2017 (2) dt.09-11-2017 2/2 true version. Co-accused Sonalal Bhagat @ Raju Kumar Malakar has already been allowed pre-arrest bail today itself vide Cri. Misc. No. 50469 of 2017 and, as such, the petitioners deserve sympathetic consideration.
The learned A.P.P. fairly submits that co-accused Sonalal Bhagat @ Raju Kumar Malakar has been allowed prearrest bail. In the facts and circumstances as stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Pipra P.S. Case No. 274 of 2015, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
