JUSTICE SANJAY PRIYA ORAL ORDER 05-12-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Patepur P.S. Case No. 34 of 2017 instituted for the offence under Sections 302/34 of the Indian Penal Code.

In the written report there is specific allegation against this petitioner of causing firearm injury to the husband of the informant on account of which he died. It is also mentioned in the Fard-beyan that prior to 4-5 days of the occurrence, altercation took place between husband of the informant and this petitioner. The petitioner had assaulted the husband of the informant and also given threat to kill him.

Patna High Court Cr.Misc. No.53333 of 2017 (3) dt.05-12-2017 2/2 The Doctor has found firearm injury on the lower chest and death of the deceased was caused due to firearm injury. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be considered/disposed off by the court below in accordance with law without being prejudiced by this order.
