Sri Satyendra Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 16-11-2017 Heard Sri Parashuram Singh, learned counsel for the petitioner and Sri Satyendra Prasad, learned Additional Public Prosecutor.

The sole petitioner, who is in custody since 13.04.2017 in Sigori P.S. Case No. 105 of 2014, registered for the offence under Section 25(I-b) a / 26 of the Arms Act , 1959 has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that on false allegation of recovery of one country made pistol, three live cartridges , one empty cartridge and one Bhidoliya the petitioner was arrested . He submits that since earlier also petitioner was an accused in a case relating to offence under the Arms Act, 1959 , the petitioner has falsely been implicated in the present case. He further submits that petitioner is in

Patna High Court Cr.Misc. No.55264 of 2017(2) dt.16-11-2017 2/2 custody since 13.04.2017 without speedy trial. Considering the period of custody and the nature of accusation, let the petitioner Rajnish Sharma @ Rajnish Kumar @ Tilha Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Danapur / concerned court in connection with Sigori P.S. Case No. 105 of 2014 with condition that one of the bailors must be blood relation of the petitioner and secondly during trial on each and every date petitioner shall remain physically present before the trial court. If continuously on two dates without prior permission of the trial court petitioner remains absent, his bail bond shall automatically stand canceled.
