JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,354A,504 and 506/34 of the Indian Penal Code and section 3(1)(xi) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

It is alleged that while the informant was returning to her school, petitioner no. 3 Rohit Yadav called her by addressing Babli Madam. On protest Rohit slapped her. Thereafter, co accused Rajpal tried to push the informant back when petitioner nos. 1 and 2 being father and grand father of petitioner no. 3 Rohit

Patna High Court Cr.Misc. No.1489 of 2016 (2) dt.12-01-2016 2/2 came and abused the informant by calling the caste name. It is submitted by the learned counsel for the petitioners that petitioner no. 3 is the class mate of the informant and for a petty dispute the accusation has been levelled. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the genesis of the occurrence and thrust of accusation against petitioner no. 3 who is classmate of the informant, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Jehanabad in connection with Ghoshi P.S. Case No. 190 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
