The petitioners seek bail in a case instituted under Section 30(a) of Bihar Prohibition and Excise Act, 2016. It is alleged that 20 litres of country made liquor is said to have been recovered.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 20.08.2017. The petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. It is alleged that 20 litres of country made wine is said to have been recovered. There is no compliance of section 100 of the Cr.P.C.
Patna High Court Cr.Misc. No.50256 of 2017 (2) dt.17-10-2017 2/2 On behalf of the state, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Motihari, East Champaran, in connection with Dumariyaghat P.S. Case No. 114 of 2017.
