The petitioner seeks bail in a case registered under Sections 399, 404, 414 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act.

The prosecution case is that after having received the confidential information, a raid was conducted and six persons were apprehended from whose possession arms and ammunition, cash and other articles were recovered. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 18-08-2018. There is no recovery of arms from possession of the petitioner. There is no compliance of Section 100 Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub JudgeXV-cum-ACJM, _Patna in connection with Phulwari Sharif P.S. Case No. 613 of 2018.
